Slater and Gordon are decent no win no fee solicitors. Your mum has some nasty injurys and will be looking at a good size pay out so they will happily take the case and all costs will be picked up by the drivers insurance.

The drivers insurance will try to knock something for the no helmet thing, DONT ACCEPT THAT, they'll try it on but they will back down as if the case goes to court as they will side with your mum. (Sorry to mention helmet thing, I used to work in injury claims and I know they'll try it on)

I love it when a motorcyclist rocks up to lecture cyclists on safety and doing "stupid stuff". Despite only making up 1% of road users, they make up approximately 19% of deaths and serious injuries. cyclist 2% and 10% respectively.

Unfortunately I think most driver training is just advisory, like most of the Highway Code when it comes to criminal cases. Most judges will happily tell a jury to disregard the Highway Code if it helps the defence of a driver.

A driver not following their training and killing somebody should lead to an open and shut civil case, like that matters in the grand system of road carnage and truck drivers who are multiple killers.

Not seeing something when your in charge of a ton of metal shouldn't be a get out of jail free card, it should be an indication of guilt. Seeing stuff is the least we should expect from a careful and competent driver.
