Probably easiest to start with what parts of the frame aren't Max:
From looking at the photos you've provided I'd also say that these tubes probably aren't Max (based on the amount of bb shell you can see outboard of the tube junctions):
Down tube (also based on the lack of any obvious ovalisation at the junction with the ht)
So (IMHO) tt only is a Max tube, although usual caveats apply as diagnosis made from photos only.
The tube dimensions of the Max tubeset are easily found online, you are in a much better position to measure what you have and make a decision based on that.
Looks more like moleskin to me (no moles were harmed I’m sure)

After failing to shift it in the last 3 months I’d only be looking for postage costs and a forum donation for the f&f.
Any reason you can’t just file/machine off the bit of the spacer that’s profiled to fit the curve of the downtube? All you need is for the square recess on the spacer to fit onto the square section of the shifter boss isn’t it? I’ve probably got a couple of spare spacers if you want to try without destroying one of yours.
