You can see how this will go, deny dangerous driving, admit careless, 6 months suspended and 6 point on the license.
It’s a story as old as time.
The driver is in court today. If anyone sees a report on it, would you mind posting a link later today.
This guy should never drive again.
I can't seem to find any reporting from that court appearance, but perhaps it's not a done thing and reserved for the actual trial. Ham & High only has this write-up of the police release:
Case adjourned till June.
^^Doubt H&H ever send to magistrates' courts these days.
Unless it's a high profile case it's probably not going to be covered by anyone...
the death of local journalism
According to this article it went to court yesterday and was adjourned till 4th of June:
At the next hearing he gets to enter a plea. I know next to nothing about the court system - but what were they doing yesterday if nothing has actually happened?
Ah, thanks, I missed that.
Isn't it that a case has to be opened formally, even if it can't be proceeded with straightaway? Lawyers need to be hired and prepare, the court is busy, etc. It's probably a bit like a timetabling session.
It seems he was held in custody so has to be put in front of a magistrate almost straight away.
It's been refereed up to a Crown Court which would appear to mean he is being charged with something that could include a sentence that is longer than a magistrates court can impose (6 months?.)
(I think, IANAL)
It's been refereed up to a Crown Court
It's been refereed up to a Crown Court
Who's the bastard in the black BMW?
"In the Crown Court, the maximum sentence is five years' imprisonment and/or a fine. In the Magistrates' Court the maximum sentence is six months imprisonment and/or a fine. In both courts, there will also be a mandatory two year minimum period of disqualification and endorsement. The law also requires an extended retest upon conviction"
Anyone know the area the guy is from? The arrest and custody until court would make me wonder where he is from. I note he has a vaguely ‘Irish’ name but he has provided a U.K. address.
Wtf has an Irish name got to do with anything
I have my reasons for asking. Odd he was arrested and not bailed. Just wondering why this would be.
Probably best not to discuss stuff that’s likely to be contempt of court on a public forum?
(Like reasons why bail was denied if it was indeed sought)
Sure we wouldn’t want the case to fail because of this
The Bail Act will give the various reasons why bail can be refused by magistrates.
Um. The guy was obviously not given police bail after arrest and charge. I’m interested in the reason for that. Not Court Bail.
What does your interest achieve?
Over any possible negative impact it may have.
My interest is my interest. It has no negative impact on anything. It relates to procedure and nothing else.
Edit: it doesn’t even matter
Update from ITV London:
"29 year old Sean Fagan has pleaded guilty to causing serious injury by dangerous driving, failing to stop after a road accident and being the driver of a vehicle involved in a road accident + failing to report it to police.
He’ll be sentenced on 2nd July."
So glad they've identified him.
What an absolute prick.
The penalty will be interesting and, I suspect, not severe. It’s a disgrace.
As he has pleaded guilty,
why does the Justice system take another month to sentence him?
