  • The injured man's grandson has written a detailed description of the accident and charges: http://tracksideviews.com/2013/08/06/responsibilities/

The writtings show that he is an experienced, logical and not hot tempered biker, although he wasnt present, he seems to know the event pretty well, so by that i can assume he is correct.

  • From a purely academic point of view, can anyone find me numbers for drivers convicted for involuntary GBH where a member of the public on a bus has been injured after the bus had to brake sharply due to the actions of a driver of a motor vehicle?

This cannot be the first time an injury such as this has happened.

  • Google is littered with articles where older members of the public have been injured while traveling as passengers in a bus when it is involved in a crash.

None so far I can find refer to the driver of the 3rd party vehicles being charged for anything.

  • There's also a ridiculous amount of No Win No Fee types offering claims against bus companies for injuries sustained while traveling as a passenger.

  • The reason for the emergency stop was a teenager on his bike who rode out in front of the bus without warning or without looking, backed up by witness accounts and CCTV footage. The lad on the bike came off his bike but was generally ok. He had picked up his bike and moved to the roadside as a crowd of people gathered.

    .

  • This from May:

However, I'd say the circumstances leading up to the event are hardly comparable, the driver in this case behaving much worse by comparison.

  • Total sympathy with the injured man and his family, but, as a result of this, I look forward to hearing about drivers being charged similarly when they injure other road users as a result of dumb shit like this.

Oh wait, that won't happen. Because everyone drives.

  • he wasnt present
    Worth highlighting.

Looks like the GBH charge referred only to the injuries sustained by the other occupants of the driver's car.

And he gave no indication of pleas to charges of inflicting grievous bodily harm to his car passengers

  • A cursory Google would suggest that you could claim that the bus company is negligent for not providing suitable safety for its passengers, given the sheer number of bus accident related injuries recorded in the past.
