thanks again. that Times article mentions 'collision' and 'being hit' and that there is an investigation. Perhaps we should wait and see.

That is always wise in these cases, although it's worth pointing out that the key witness won't be giving evidence, as a police collision investigator pointed out to me once when seeking to explain why it's so difficult to prosecute in these cases.
