  • Originally the lack of a ban was only supposed to apply to doing your job or performing that act which would prevent excessive hardship (things like rural families having to get their kids 10 miles to school down A roads etc). Anything beyond that was a driving whilst banned offence. Alas that's close to unenforceable by a police force barely able to cope with more clear cut offences so it becomes meaningless.

    I reckon jury's and judges should provide a reasonable justification why a ban isn't being applied and describe the hardship being prevented. Might at least make it a bit more credible.

    I'd like to see any justifiable non-bans (and I'm prepared to accept some slender circumstances that provide for this) be accompanied by some inescapable community service, preferably with the victims of RTA's.

    There really needs to be a more holistic element to our justice system.
