They are now(ish). The Hour Record forces riders to use Merckx-like bikes whereas the Best Human Effort/Absolute Hour is less restricted.
Sosenka got past this in a way, since he used a very heavy rear wheel creating a flywheel effect apparently. The spoke count was 16+ and rim was box section so it was legal, but the rim was made quite heavy. So, they can put rules in place and then people will get around them anway. "Sosenka used an unusual saddle position and a small vertical frame height to stay within UCI regulations." from wiki. He was also doping.
