The seller has the power to select "buyer and seller mutually agreed not proceed with the transaction" or something, which would then send yourself an email to confirm that's the case... then the item sale disappears.
Also, eBay is still just a "meeting ground" for buyers and sellers legally, so I personally wouldn't pay for something that the seller doesn't want to get rid of... endless trouble.
