is it the neighbour building the house, or is he employing a builder to build the house?
if the neighbour has run out of money to pay the builders and scaffolders and has pissed them off enough that they're smashing stuff up then good luck getting any cash off them!
I'd ask for the cash asap, and if they've not handed it over within a week then put a claim in.
